Contrary to media and blogger reports, Apple Inc. and Mac clone maker Psystar Corp. have not suspended their legal wrestling, a lawyer for Psystar said today. The fact that the two parties have filed documents with a federal court promising that they would take their dispute to Alternative Dispute Resolution (ADR), a legal process that can include mediation, is “a nonstory,” said Colby Springer, an attorney at Palo Alto, Calif.-based Carr & Ferrell LLP, who is on the team representing Psystar.

Print Apple may have finally decided to kill the Mac Mini, according to a report. (Credit: CNET) After relegating it to the hinterlands of its Mac lineup for years, Apple might be finally ready to put the Mac Mini to sleep. That’s what Gizmodo thinks , having talked to two European retailers who say they can no longer order the $599 box from Apple.

Mark/Space, developer of well-known synchronization software The Missing Sync, has released its new Fliq application for the iPhone and iPod touch. Fliq is a social networking application that allows iPhone and iPod touch users to send photos and contacts to one another. Fliq offers real-time social networking between friends in close proximity, said Brian Hall, CEO of Mark/Space.

In its motion to dismiss, which it filed Sept. 30, Apple said that the Doral, Fla.-based clone maker’s claim that Apple is a monopoly is ‘њdeeply flawed’ќ and should be tossed out by U.S. District Court Judge William Alsup. Apple also asserted that it could not be compelled to license its operating system to rivals, such as Psystar. ‘њNeither the federal nor the state antitrust laws require competitors to stop competing with, and instead to start helping, each other,’ќ the computer maker argued.

Investors are in high anticipation of Apple’s quarterly report today in hopes that its outlook will provide clear clues on the state of consumer spending. While the economic slowdown has crimped business investment in technology, Apple has remained relatively unaffected, but analysts say they believe growing consumer pessimism could undermine the company’s sales going forward.

Speedmark 5 scores are relative to those of a 1.5GHz Core Solo Mac mini, which is assigned a score of 100. Adobe Photoshop, Cinema 4D XL, iMovie, iTunes, and Finder scores are in minutes:seconds. All systems were running Mac OS X 10.5.2 with 2GB of RAM, unless otherwise indicated. The Photoshop Suite test is a set of 14 scripted tasks using a 50MB file. Photoshop’s memory was set to 70 percent and History was set to Minimum. We recorded how long it took to render a scene in Cinema 4D XL.

NO F*#&ING firewire! Are you F*%&ing kidding me!!! Way to completely ruin a good computer! I’ve been using my macbook for editing, video capture, I have back up devices on FW… wow. They just blew it on a whole population of users upgrading to a new macbook. I took my black one and put a 7200 rpm drive, and maxed the RAM… it edited as well as the towers. Damnit apple! You f*&$ed up.
